Terms of Service

Introduction

These Terms of Service (“Terms” or “Agreement”) constitute a legally binding contract between you (“User,” “you,” or “your”) and K‑Go LLC (“K‑Go,” “we,” “our,” or “us”) governing your purchase, use, and access to the K‑Go fitness device, companion mobile application, and related services (collectively, the “Services”). By purchasing our products, creating an account, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Services immediately.


Eligibility

The Services are intended solely for individuals aged 18 years and older. By accessing or using the Services, you represent and warrant that you meet this age requirement. The Services are not designed for children or minors, and we do not knowingly collect personal information from individuals under 18. Any use of the Services by persons under 18 is strictly prohibited and constitutes a violation of these Terms.


Use of Device and App

The K‑Go fitness device and mobile application are designed exclusively for personal fitness purposes. The app enables you to track workouts, control resistance, log sessions, and store personal details such as height, weight, age, and gender to personalize your experience. You agree not to use the Services for medical diagnosis, commercial gym resale, rental, or institutional purposes. You further agree to operate the device and app in accordance with all instructions contained in the User Guide. Misuse, unauthorized modifications, reverse engineering, or use of unauthorized accessories may result in injury, void your warranty, and constitute a breach of these Terms.


Accounts and Security

To access certain features of the app, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to maintain and promptly update such information. You are solely responsible for safeguarding your login credentials and for all activities conducted under your account. If you suspect unauthorized access, you must notify us immediately. K‑Go LLC shall not be liable for any loss or damage arising from your failure to maintain the confidentiality of your account information.


Orders and Payments

All purchases are one‑time transactions denominated in USD and processed through secure payment providers such as Stripe. Prices, availability, and product descriptions are subject to change without notice. Once an order is confirmed, you authorize us to charge the payment method provided for the total amount displayed at checkout.


Returns and Refunds

K‑Go products may be returned or refunded within the 1‑year warranty period if a genuine defect or issue covered under warranty is identified. Refunds are not available for normal wear and tear, misuse, or conditions excluded from warranty coverage. To initiate a return or refund, you must contact us at support@myk-go.com with proof of purchase and a description of the issue. Upon approval, we will provide instructions for returning the product. Refunds will be issued only after the product is received, inspected, and confirmed to meet warranty conditions.


Limited Warranty

K‑Go LLC warrants that the fitness device will be free from manufacturing defects for a period of one (1) year from the date of purchase. If a defect arises during the warranty period, K‑Go will, at its discretion, repair or replace the product at no additional cost. Warranty claims must be submitted by email to support@myk-go.com with proof of purchase.

Exclusions

This Limited Warranty does not cover:

  • Normal wear and tear.

  • Cosmetic damage (scratches, dents, discoloration) not affecting functionality.

  • Damage caused by accidents, abuse, misuse, neglect, improper storage, or transportation.

  • Damage resulting from unauthorized repairs, alterations, or modifications.

  • Use of unauthorized accessories, chargers, or attachments.

  • Products used for commercial, rental, or institutional purposes.

  • Damage resulting from failure to follow the User Guide or operating instructions.

  • Products with removed, altered, or illegible serial numbers.

  • Lost or stolen products.


Limitation of Liability

To the fullest extent permitted by applicable law, K‑Go LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to personal injury, property damage, loss of data, or loss of profits, arising out of or related to your use of the Services. Fitness devices involve physical activity, and you assume all risks associated with their use. You are solely responsible for ensuring that you are medically fit to use the device and app. Always consult a physician before beginning any exercise program.


Intellectual Property

All content, trademarks, logos, software, and related materials associated with the Services are the exclusive property of K‑Go LLC. You are granted a limited, non‑exclusive, non‑transferable license to use the Services for personal fitness purposes only. Any unauthorized reproduction, modification, distribution, or derivative works are strictly prohibited and may result in legal action.


Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services, you consent to the practices described in the Privacy Policy.


Termination

These Terms shall remain in effect unless and until terminated by either party. You may terminate this Agreement at any time by notifying us that you no longer wish to use the Services or by ceasing all use of the device, app, and website. Termination shall not relieve you of any obligations or liabilities incurred prior to the effective date of termination, all of which shall survive termination.

K‑Go LLC reserves the right, in its sole discretion, to suspend or terminate this Agreement immediately and without prior notice if you fail, or if we reasonably suspect that you have failed, to comply with any provision of these Terms. In such event, you shall remain liable for all amounts due up to and including the date of termination, and we may deny you access to the Services, in whole or in part. Provisions relating to warranty disclaimers, limitations of liability, indemnification, and governing law shall survive termination.


Governing Law

These Terms and any disputes arising out of or relating to the Services shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Michigan for the resolution of any disputes.


Changes to Terms of Service

You may review the most current version of these Terms at any time on this page. K‑Go LLC reserves the right, at its sole discretion, to update, modify, or replace any part of these Terms by posting revisions to our website. It is your responsibility to check our website periodically for updates. Any changes will take effect immediately upon posting unless otherwise stated. Your continued use of the Services after such changes constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must discontinue use of the Services.
