KGO Terms of Service

These Terms of Service (the “Terms”) govern your use of myk-go.com (the “Site”) and purchases from K-Go LLC, doing business as KGO (“KGO,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms and the policies displayed on the Site, including our Shipping Policy, Return and Refund Policy, and Privacy Policy. If you do not agree, do not use the Site.

1. Products and availability

We try to describe and display our products accurately. Colors and appearance may vary by device, and measurements and specifications are approximate unless stated otherwise. Product descriptions, prices, promotions, and availability may change without notice. We may limit quantities, discontinue products, or refuse orders where permitted by law.

2. Orders

Your order is an offer to purchase. An order confirmation acknowledges receipt but does not necessarily mean we have accepted your order. We accept an order when we send a shipping confirmation or otherwise expressly confirm acceptance.

We may decline or cancel an order before acceptance because of suspected fraud, payment or pricing errors, product unavailability, shipping restrictions, unusually large quantities, or a violation of these Terms. If we cancel an order after charging you, we will refund the amount charged for the canceled item or order to the original payment method, subject to applicable law.

You are responsible for checking your order and providing accurate billing, shipping, and contact information. Contact help@myk-go.com promptly if you notice an error. We cannot guarantee that an order can be changed or canceled after submission.

3. Prices, payment, and taxes

Prices are stated in U.S. dollars (USD). Shipping charges and applicable taxes will be shown at checkout. You authorize us and our payment processors to charge your selected payment method for the total shown. You represent that you are authorized to use that payment method.

We may correct genuine typographical, pricing, or calculation errors. If a correction affects an order you submitted, we will notify you and, where required, allow you to confirm the corrected order or receive a cancellation and refund.

4. Shipping and delivery

KGO ships to available destinations worldwide except India. Standard shipping is free within the contiguous United States. Shipping charges apply to Alaska, Hawaii, and international destinations and will be displayed at checkout. Available shipping methods, processing estimates, and delivery estimates are stated at checkout or in the Shipping Policy displayed on the Site. Delivery dates are estimates unless expressly guaranteed.

We will ship within the time stated in our offer or, if no time is stated, within the period required by applicable law. If we cannot ship on time, we will provide any notice, consent option, cancellation right, or refund required by law.

You are responsible for providing a complete and accurate delivery address. If tracking is available, it will be sent by email after shipment. Risk of loss and title pass as provided by applicable law and the applicable carrier arrangement. Nothing in this section limits your rights concerning goods lost or damaged in transit.

International orders may be subject to customs procedures, import duties, taxes, brokerage fees, restrictions, and delays. Unless checkout expressly states otherwise, the recipient is responsible for these charges. You are responsible for ensuring that a product may lawfully be imported into the destination country.

5. Returns, refunds, and cancellations

Returns, exchanges, refunds, damaged or defective products, final-sale items, and cancellations are governed by the Return and Refund Policy displayed on the Site at the time of purchase. That policy is incorporated into these Terms.

Nothing in these Terms or our policies limits a right or remedy that cannot lawfully be waived, including applicable rights concerning defective, misdescribed, or undelivered goods.

6. Intellectual property and Site use

The Site and its contents, including text, graphics, names, logos, photographs, videos, designs, and software, are owned by or licensed to KGO and protected by intellectual-property laws.

KGO grants you a limited, revocable, nonexclusive, nontransferable license to use the Site for lawful personal shopping. You may not copy, reproduce, modify, distribute, sell, scrape, reverse engineer, interfere with, or gain unauthorized access to the Site or its contents, except as applicable law expressly permits or we authorize in writing.

7. Privacy

Our Privacy Policy, displayed on the Site, explains how we collect, use, disclose, and protect personal information. Please review it before using the Site. The Privacy Policy is incorporated into these Terms to the extent stated in that policy.

8. Third-party services

The Site may use third-party services such as Shopify, payment processors, and shipping carriers. Third parties are responsible for their own services, terms, and privacy practices. To the extent permitted by law, KGO is not responsible for third-party services outside our control.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” KGO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. ANY WRITTEN PRODUCT-SPECIFIC WARRANTY WILL CONTROL TO THE EXTENT IT CONFLICTS WITH THIS SECTION.

SOME STATES DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. THESE DISCLAIMERS APPLY ONLY TO THE EXTENT PERMITTED BY LAW, AND NOTHING HERE EXCLUDES A WARRANTY OR RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KGO AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THEIR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE, PRODUCTS, OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM OR US $100.
